Psychiatric expert state witness lies against Scottish whistle blower?


Today the Herald ran a story headlined

"Edinburgh psychiatrist 'must answer' claim she fabricated damning report on former Ministry of Justice employee"

In summary - a man working for the Criminal Injuries Compensation Authority, which is part of the UK Ministry of Justice, in Glasgow blew the whistle on wrong doing within this UK government department - and got sacked for it.

The man took the CIC to an industrial tribunal for wrongful dismissal which led the UK Ministry of Justice to hire an "expert witness" to write a psychiatric report on his mental health, to be used by them at his industrial tribunal - where they knew the whistle blower would accuse management of fabricating evidence against him to sack him wrongfully.

The General Medical Council (GMC) now accuses this psychiatrist "expert witness", for the state, of fabricating evidence against the whistle blower for the MOJ, to discredit him at the industrial tribunal (so they would win the case).

Dr Jane McLennan, is reported to have worked for the Scottish Government as one of their "national panel of specialists", lectured in psychiatry at the Universities of Dundee and Stirling and is a consultant psychiatrist at the Royal Victoria Hospital in Edinburgh.

The Scottish Government's National Panel of Specialists decide which doctors get to become consultants in the NHS - so she is one of the most influential psychiatrists in Scotland.

We only know about this woman's actions because the whistle blower, as a last port of call, in an attempt to prove the MOJ paid expert witness had lied, gave the GMC an audio recording of her assessment (he secretly recorded on his smart phone at the time) and a copy of the report she produced - to prove she had fabricated evidence against him - to discredit him at his industrial tribunal as the state's "expert witness" - so someone would finally hold her to account.

Previously he had presented the evidence of her likely perjury to the police and the procurator fiscal, who refused to prosecute.

Since then this powerful state psychiatrist has been trying to block the GMC case against her, by again attempting to discredit the CIC whistle blower, as the Herald went on to reveal the psychiatrist's lawyer claimed

"Mr A was an unreliable witness and a “stranger to the truth”.They also criticised the submission into evidence of an audio recording of the consultation - covertly taped by Mr A on his smartphone and said to contradict several sections of her report – saying it was "difficult to understand" and occasionally inaudible.".

But the GMC have compared the recording and the subsequent report she submitted for the MOJ at the industrial tribunal and ruled the case will continue against her in December, with the Herald report going on to say

"On a number of counts, the Medical Practitioners Tribunal Service (MPTS) said dishonesty by Dr McLennan was the "more probable" explanation for the contradictions between the audio recording and the psychiatric report.

If she is found to have lied, Dr McLennan - who has been an expert witness in a number of cases - may be struck off. ".

This then puts into doubt every case where she has been used as an "expert witness" and also means every patient she has involvement with we must question when any psychiatric report has been used against them too.

One Flew Over the Cookoo's Nest, Nurse Ratched comes to mind as she has become "a popular metaphor for the corrupting influence of power and authority in bureaucracies such as the mental institution in which the novel is set".

While this is the MPTS assessment of the evidence so far, it must be asked, why then did the police and Crown Office in Scotland refuse to prosecute her for perjury, despite having the same evidence provided.

The case should have been heard in March but legal arguments were made to bog it down so it ran out of time.

When the CIC, the MOJ, an industrial tribunal panel, the Crown Office and the police in Scotland and legal teams all work together to suppress information of evidence fabricated against a man sacked for exposing wrong doing in a state department - to block honest investigation together - this demonstrates just how many people and state departments in Scotland and Westminster departments, get involved in state cover ups.

If it was not for the GMC and the man's determination to prove his perceived wrong doing of this consultant psychiatrist so far backed by the GMC tribunal, we would know nothing of this case.

If ever there was a case that warranted not just criminal injuries compensation but a full court case, heard by a jury, against not just the psychiatrist but everyone involved, so a jury can decide the truth of, not only the man's whistle blowing allegations against the CIC and the resulting treatment by managers and colleagues but what happened next and all those involved - so we can all hear the evidence in open court and prosecute all those involved.

And, at the least, right now, the CIC should be forced to pay this man criminal injuries compensation for the crimes against him.

With the MOJ, the Police and Procurator Fiscal Service and this psychiatrist forced to pay damages for lost earnings - each and every one - and compensation for mental anguish caused because of their actions should they be found guilty in court of perverting the course of justice.

This case calls the entire psychiatric profession in Scotland into question and shows how they can be used against ordinary citizens any time the all powerful state wants to cover up wrong doing in government departments and discredit and ruin any whistle blower, for life.

This case is exactly the same state scam being used against the sick and disabled, all over the country, to make false reports against them for the DWP - as people complain up and down the country the assessments passed to the DWP bare no relation to what was discussed in their interview in the assessment centre.

Proving this is not just the Ministry of Justice "expert witness" - this country is being run by a state that bares false witness against whistle blowers and the most vulnerable people in our society to block their legitimate claims for benefits and against wrongful dismissal.

And to use one of the most powerful and connected psychiatrists in Scotland to do this, a woman who they claim is a specialist in "elderly" psychiatry, the most vulnerable section of our society, is the most dangerous weapon any government department can use - which is why the GMC is taking this case so seriously, despite the the attempts to block them too.
